Back by popular demand for the 5th year in a row, this session addresses the latest legal issues impacting the testing industry, presented by a panel of 4 attorneys, including in-house and outside counsel, all with extensive experience representing testing organizations. In the first 30 minutes, panelists will provide updates in areas of law experiencing significant change, current litigation, or ongoing uncertainty. Topics include the latest developments in copyright rules for secure tests, privacy regulations in the US, Europe, UK, China and elsewhere, the Americans with Disabilities Act, and legal risks of AI systems and platforms, including generative AI used to develop and modify test content, AI in test delivery and monitoring, and other AI-driven assessment applications. The remaining 20 minutes will be dedicated exclusively to audience questions. Panelists will share actionable strategies to help programs and service providers adapt to emergent technology and changing laws.
